Blackhawk Outfitters Ltd. ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website, purchase products, or conduct firearm transfers through our Federal Firearms License (FFL: 5-84-035-01-9A-17323) facility.

As a federally licensed firearms dealer, we are required to collect and maintain certain information in compliance with federal law (18 U.S.C. § 923(g), 27 CFR § 478.124-478.129) and Colorado state law (C.R.S. § 24-33.5-424). This policy describes both our legal obligations and our voluntary privacy practices.

2. Information We Collect

2.1 Personal Information You Provide

For All Customers (Firearms and Non-Firearms):

  • Name, email address, phone number, billing and shipping addresses
  • Payment information (processed securely through third-party processors; we do not store full credit card numbers)
  • Purchase history and product preferences
  • Communications with our customer service team

For Firearm Purchases and FFL Transfers (Mandatory Under Federal Law):

  • Full legal name, date of birth, place of birth
  • Current residential address (no P.O. boxes)
  • Government-issued photo ID information
  • Social Security Number (optional, but may expedite background check)
  • Citizenship and immigration status
  • ATF Form 4473 responses (including disqualifying factors)
  • NICS/CBI background check transaction numbers

2.2 Automatically Collected Information

  • IP address, browser type, operating system
  • Pages visited, time spent, referring URLs
  • Device identifiers and cookies

3. How We Use Your Information

  • Process orders, transactions, and FFL transfers
  • Comply with federal and state firearms regulations
  • Conduct mandatory background checks (NICS/CBI)
  • Maintain ATF-required bound book records
  • Communicate order status and shipping updates
  • Improve our website and customer experience
  • Prevent fraud and unauthorized transactions
  • Respond to legal requests and law enforcement inquiries

4. FFL Record Retention Requirements

Important: Federal law requires licensed firearms dealers to retain ATF Form 4473 records and bound book entries for a minimum of 20 years. This is a legal obligation we cannot waive, even upon customer request. These records include:

  • ATF Form 4473 (Firearms Transaction Record)
  • Acquisition and Disposition (A&D) bound book entries
  • Background check records and transaction numbers
  • Multiple sale reports (ATF Form 3310.4)

If our business closes, all FFL records must be surrendered to the ATF as required by law.

5. Information Sharing

We do not sell your personal information. We share information only with:

  • Payment Processor: GunTab, our secure escrow-based payment processor for all transactions
  • Shipping Carriers: UPS, FedEx, USPS to deliver your orders
  • Government Agencies: ATF, FBI (NICS), Colorado Bureau of Investigation (CBI) as required by law for firearms transactions
  • Law Enforcement: When required by subpoena, court order, or applicable law
  • FFL Dealers: When transferring firearms to another licensed dealer

6. Data Security

We implement industry-standard security measures including SSL encryption, secure servers, and limited access controls. Firearms transaction records are stored in compliance with ATF requirements. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

7. Cookies

We use cookies for website functionality, analytics, and to remember your preferences. Essential cookies are required for checkout and cart functionality. You may disable non-essential cookies through your browser settings, but this may affect website functionality.

8. Your Rights

Depending on your location, you may have the right to:

  • Access, correct, or delete your personal information
  • Opt out of marketing communications
  • Request a copy of data we hold about you

Note: These rights do not apply to federally mandated FFL records (ATF Form 4473, bound book entries), which must be retained for 20 years regardless of customer requests.

9. California Privacy Rights (CCPA)

California residents have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, request deletion, and opt out of sale of personal information.
