1. Agreement to Terms

By accessing or using the Blackhawk Outfitters Ltd. website ("Website"), purchasing products, or conducting firearm transfers at our facility, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Website or services.

These Terms constitute a legally binding agreement between you and Blackhawk Outfitters Ltd., a Colorado limited liability company and federally licensed firearms dealer (FFL: 5-84-035-01-9A-17323).

2. Eligibility and Account Registration

2.1 Age Requirements

  • You must be at least 18 years old to purchase non-firearms products (outdoor gear, camping equipment, accessories)
  • You must be at least 18 years old to purchase rifles and shotguns
  • You must be at least 21 years old to purchase handguns and ammunition suitable for handguns
  • Federal law (18 U.S.C. § 922(b)(1)) prohibits sales to persons below these ages

2.2 Prohibited Persons

Federal law (18 U.S.C. § 922(g) and 922(n)) prohibits firearm possession by individuals who:

  • Have been convicted of a crime punishable by imprisonment exceeding one year
  • Are fugitives from justice
  • Are unlawful users of or addicted to controlled substances
  • Have been adjudicated as mental defectives or committed to mental institutions
  • Are illegal aliens or non-immigrant visa holders (with limited exceptions)
  • Have been dishonorably discharged from the Armed Forces
  • Have renounced U.S. citizenship
  • Are subject to restraining orders (domestic violence)
  • Have been convicted of misdemeanor domestic violence

By making a firearm purchase, you certify that you are not a prohibited person.

2.3 Account Registration

Creating an account requires accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.

3. Product Listings and Availability

We strive to display accurate product information, including descriptions, specifications, pricing, and availability. However:

  • Product images are for illustration purposes; actual items may vary slightly
  • We reserve the right to discontinue products without notice
  • Pricing errors may occur; we reserve the right to cancel orders placed at incorrect prices
  • Inventory quantities are estimates and subject to prior sale
  • Firearm specifications (caliber, barrel length, capacity) are provided by manufacturers; verify before purchase

4. Orders and Payments

4.1 Order Acceptance

Your order is an offer to purchase products. We may accept or decline your order at our sole discretion. Order confirmation does not constitute acceptance. Acceptance occurs when products are shipped or made available for pickup.

4.2 Pricing and Taxes

  • All prices are in U.S. dollars and subject to change without notice
  • Colorado sales tax is charged on applicable purchases (currently 2.9% state rate plus local rates)
  • Excise taxes on firearms and ammunition are included in listed prices
  • FFL transfer fees are separate from product prices

4.3 Payment Methods

We accept major credit cards, debit cards, and ACH transfers. Payment must clear before firearm transfers are completed. For large orders or B2B purchases, wire transfers or business checks may be accepted with prior arrangement.

4.4 Background Check Fees

Colorado law requires a background check for all firearm transfers. The current CBI fee is $15 per transaction and is collected at the time of pickup. This fee is separate from purchase price and is non-refundable.

5. Firearm Purchases and Transfers

5.1 FFL Transfer Process

All firearm transactions must comply with federal and state law:

  1. Place Order: Online or in-store selection of firearm
  2. FFL Shipping: Firearms ship to our FFL location only (no direct-to-consumer shipping)
  3. Notification: We contact you when firearm arrives
  4. In-Person Pickup: You must appear in person with valid government-issued photo ID
  5. ATF Form 4473: Complete federal firearm transaction record
  6. Background Check: NICS and CBI checks (minimum 3-day waiting period in Colorado)
  7. Approval & Payment: Upon approval and payment, firearm is released

5.2 Colorado Waiting Period

Important: Colorado law (C.R.S. § 24-33.5-424) requires a mandatory 3-day waiting period from the initiation of the background check before a firearm can be transferred, even if the background check is approved immediately. You cannot take possession until both:

  • The background check is approved (NICS and CBI), AND
  • The 3-day waiting period has elapsed

5.3 Denials and Delays

If your background check is denied or delayed:

  • Delayed: FBI has up to 3 business days to complete investigation. After 3 business days (plus the Colorado 3-day wait), the transfer may proceed at our discretion
  • Denied: Firearm will not be transferred. You may appeal to FBI (NICS) or CBI. Denial information is confidential and we cannot disclose reasons
  • Purchase price (minus background check fee) may be refunded or applied to different purchase

5.4 Private Party Transfers

Colorado law requires all private party firearm transfers to be processed through an FFL. We facilitate these transfers for a fee (see current fee schedule on our website). Both parties must be present with valid ID.

6. Shipping and Delivery

6.1 Non-Firearms Products

  • We ship outdoor gear, accessories, and non-firearm products via USPS, FedEx, or UPS
  • Shipping costs calculated at checkout based on weight, destination, and carrier
  • Standard delivery: 5-7 business days
  • Expedited options available for additional fees
  • International shipping: Not currently available

6.2 Firearms and Ammunition

  • Firearms: Ship to our FFL only; no direct-to-consumer shipping
  • Ammunition: Ships via ground carrier only (no air transport). May be restricted in certain states. Adult signature required
  • Hazmat Fees: Ammunition shipments incur hazmat fees ($25-$40 depending on carrier)

6.3 Shipping Restrictions

Certain products cannot be shipped to certain jurisdictions due to local laws. We comply with all federal, state, and local restrictions. Your order may be cancelled if shipping is prohibited to your location.

7. Returns and Refunds

See our Returns & Exchanges Policy for complete details. Key points:

7.1 Non-Firearms Products

  • 30-day return window for unused, undamaged items in original packaging
  • Refund issued to original payment method minus shipping costs
  • Defective items replaced or refunded at our discretion

7.2 Firearms

  • No returns after transfer completion (once ATF Form 4473 is completed and background check approved)
  • Cancellations accepted before shipment or before transfer paperwork is initiated
  • Manufacturer defects covered by manufacturer warranty (not by us)
  • Cancellation fees may apply if firearm has already shipped to us

7.3 Ammunition

  • No returns on ammunition due to hazmat shipping regulations
  • Defective ammunition claims must be filed directly with manufacturer

8. Prohibited Uses

You agree NOT to use our Website or services to:

  • Violate any federal, state, or local law
  • Purchase firearms with intent to transfer to prohibited persons (straw purchases)
  • Provide false information on ATF Form 4473 or other required documents
  • Engage in fraudulent activity or payment disputes in bad faith
  • Harass, threaten, or intimidate our staff or other customers
  • Attempt to circumvent background check requirements
  • Reverse engineer, decompile, or attempt to access our systems without authorization
  • Upload malware, viruses, or harmful code

9. Intellectual Property

All content on this Website (text, graphics, logos, images, product descriptions, software) is owned by Blackhawk Outfitters Ltd. or our licensors and protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Reproduce, distribute, or publicly display our content without written permission
  • Use our trademarks or logos without authorization
  • Frame or link to our Website in a manner that implies endorsement or association

Product images and descriptions provided by manufacturers remain the property of respective manufacturers.

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW:

OUR WEBSITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Website will be uninterrupted, error-free, or secure
  • Warranties regarding accuracy of product descriptions or availability

We do not warrant that products will meet your expectations or be suitable for your intended use. Firearms are inherently dangerous and must be handled responsibly.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

BLACKHAWK OUTFITTERS LTD., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Personal injury or property damage resulting from product use or misuse
  • Damages arising from unauthorized access to your account or information
  • Damages resulting from third-party conduct (shipping carriers, manufacturers, payment processors)

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

Firearm Safety: We are not liable for injuries, death, or property damage resulting from misuse, negligence, or unlawful use of firearms purchased from us. Firearms must be used in accordance with manufacturer instructions and all applicable laws.

12. Indemnification

You agree to indemnify, defend, and hold harmless Blackhawk Outfitters Ltd. from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of products purchased from us
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of any third-party rights
  • False information provided on ATF Form 4473 or other documents

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of Colorado and the federal laws of the United States, without regard to conflict of law principles.

13.2 Arbitration Agreement

Any dispute arising from these Terms or your use of our services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in Denver, Colorado, in accordance with its Commercial Arbitration Rules.

Exceptions: Either party may seek injunctive relief in court for intellectual property violations or violations of federal firearms laws.

13.3 Class Action Waiver

You agree to bring claims only in your individual capacity and not as a member of any class or representative action. Class arbitrations and class actions are not permitted.

13.4 Jurisdiction

If arbitration is deemed unenforceable, any legal action shall be brought exclusively in state or federal courts located in Denver County, Colorado. You consent to personal jurisdiction in these courts.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of our Website or services after changes are posted constitutes acceptance of the modified Terms. We will notify registered users of material changes via email.
