1. Agreement to Terms
By accessing or using the Blackhawk Outfitters Ltd. website ("Website"), purchasing products, or conducting firearm transfers at our facility, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Website or services.
These Terms constitute a legally binding agreement between you and Blackhawk Outfitters Ltd., a Colorado limited liability company and federally licensed firearms dealer (FFL: 5-84-035-01-9A-17323).
2. Eligibility and Age Requirements
- You must be at least 18 years old to purchase non-firearms products (outdoor gear, camping equipment, accessories)
- You must be at least 18 years old to purchase rifles and shotguns
- You must be at least 21 years old to purchase handguns and handgun ammunition
- Federal law (18 U.S.C. § 922) and Colorado law govern all age requirements
By placing an order, you represent and warrant that you meet all applicable age requirements.
3. Firearm Purchases
3.1 Background Check Requirement
All firearm purchases require completion of ATF Form 4473 and successful completion of a background check through the Colorado Bureau of Investigation (CBI) InstaCheck system. A $15 fee applies for the state background check.
3.2 Colorado Waiting Period
Colorado law requires a minimum 3-day waiting period between the initiation of a background check and the transfer of a firearm. This period cannot be waived.
3.3 Prohibited Persons
Under 18 U.S.C. § 922(g), the following persons are prohibited from purchasing or possessing firearms:
- Persons convicted of a crime punishable by imprisonment for more than one year
- Fugitives from justice
- Unlawful users of or addicted to controlled substances
- Persons adjudicated as mental defective or committed to a mental institution
- Illegal aliens or non-immigrant visa holders (with limited exceptions)
- Persons dishonorably discharged from the Armed Forces
- Persons who have renounced United States citizenship
- Persons subject to certain restraining orders
- Persons convicted of a misdemeanor crime of domestic violence
3.4 Straw Purchases
Straw purchases are a federal felony. You may not purchase a firearm on behalf of another person. The actual buyer must be the person completing ATF Form 4473. Violations are punishable by up to 10 years in prison (18 U.S.C. § 922(a)(6)).
3.5 Denial and Appeals
If your background check is denied, the sale cannot proceed. You may appeal a denial through the FBI NICS Section or the Colorado Bureau of Investigation. We are not responsible for delays or denials in the background check process.
4. FFL Transfers
We provide FFL transfer services for firearms purchased from other dealers. Transfer fees, requirements, and procedures are detailed on our FFL Transfer page. All transfers are subject to the same background check and waiting period requirements as direct purchases.
5. Shipping and Delivery
Shipping policies, rates, and restrictions are detailed on our Shipping Information page. By placing an order, you agree to:
- Provide accurate shipping information
- Comply with all applicable shipping restrictions for your state
- Accept that firearms can only be shipped to licensed FFL dealers
- Accept that certain items cannot be shipped to restricted states
6. Returns and Refunds
Our return policy is detailed on our Returns & Exchanges page. Key points:
- Non-firearm items: 14-day return window for unopened, unused items in original packaging
- Firearms sales are final once the background check (Form 4473) has been initiated
- Ammunition cannot be returned due to safety regulations
7. Pricing and Payment
All prices are listed in US Dollars. We reserve the right to modify prices at any time without notice. Prices are not finalized until your order is confirmed. We are not responsible for typographical errors in pricing. Payment must be received in full before items are shipped or transferred.
8. State-Specific Restrictions
Certain products may not be available for purchase or shipment to all states due to state and local laws. It is your responsibility to know the laws in your jurisdiction. We reserve the right to cancel any order that would violate applicable law. Common restrictions include magazine capacity limits, specific firearm models, and ammunition types.
9. Product Descriptions and Accuracy
We make every effort to accurately describe and display our products. However, we do not warrant that product descriptions, images, or other content are accurate, complete, or error-free. Colors may vary due to monitor settings. If a product you receive differs materially from its description, contact us for a resolution.
10. Intellectual Property
All content on this Website, including text, images, logos, and design, is the property of Blackhawk Outfitters Ltd. or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or use any content without our written permission.
11. Limitation of Liability
To the maximum extent permitted by law, Blackhawk Outfitters Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Website or products. Our total liability shall not exceed the amount you paid for the specific product or service giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Blackhawk Outfitters Ltd. from any claims, damages, or expenses arising from your violation of these Terms, misuse of products, or violation of any applicable law.
13. Dispute Resolution
Any disputes arising from these Terms or your use of our services shall be governed by the laws of the State of Colorado. You agree to submit to the exclusive jurisdiction of the courts located in Denver County, Colorado. Before filing any legal action, you agree to attempt good-faith negotiation for at least 30 days.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our Website or services after changes constitutes acceptance of the modified Terms.
